Exclusion of liability 

Preamble:

MOSER Trachten GmbH shall be liable for damage caused by it or by its legal representatives or vicarious agents as a result of willful intent or gross negligence, without limitation in accordance with statutory regulations. MOSER Trachten GmbH shall also be liable in case of breach of material contractual obligations, the absence of guaranteed qualities or personal injuries due to unauthorized actions.

Material contractual obligations are obligations that are absolutely necessary for the proper performance of the contract and that the customer can normally trust and expect to be complied with. It includes all contractual obligations, necessary for the preservation of the rights of the customer, which are granted by the contract with regard to its content and purpose; and as well, it includes those contractual obligations, without which the essential rights and obligations, which arise from the nature of the agreement, would be restricted to an extend that the attainment of the purpose of the contract might be compromised.

In simple cases of negligence MOSER Trachten GmbH´s liability shall be limited to the violation of material contractual obligations or in case of injuries of life or limb, or in the presence of arrears or impossibility of performance. In case of simple negligence, the liability of MOSER Trachten GmbH of damages that are not based on injuries of life or limb, are limited to the contract typical damage and on such damage that was foreseeable, as long as an essential contract obligation was violated, or in case of arrears, or the impossibility of performance is present. The customer shall retain the right to prove a higher damage.  

Claims under the German Product Liability Law (Produkthaftungsgesetz) remain unaffected, as well as claims under warranty, producer liability or other legally compulsory regulations.
